For the 2025 election, which concluded on April 10, 2025, we paid the professional Inspector of Elections $11,446.02. (Now that the election has concluded, there will probably be more costs due to the second trip to Novato and for issuing the notice with the election results.) In the Inspector's contract proposal, the two service options were for $2,500 (for "full service") or $1,900.

DownloadThe annual 2025 Election was held on April 10, 2025! (And the previous election was held in May 2021.) The following were elected to be Directors: Chuck Moore 90 votes (2-year term), Christina Olcomenday 88 votes (2-year term), Amy Blakeney 68 votes (1-year term), Michael Christian 62 votes (1-year term), and Pat Eklund 55 votes (1-year term).

In March 2024, the PMA Board notified the members that the cost of the Directors & Officers (D&O) insurance policy had increased from $3,400 annually to $27,167 annually (an 8-fold increase). See the attached letter. However, the drastic change actually occurred in December 2023. See the December 2023 payment information below. In addition, the PMA Board never discussed or approved the D&O insurance policy changes during a Board meeting in open session.
The Board also decided to postpone the membership meeting for the election until Monday, February 24, 2025. This was required because the Board provided conflicting information about the ballot submission dates (by mail or in person), failed to provide contact information for the Inspector of Elections, and failed to provide a link to the PMA Election Rules. The Board also failed to inform the members about "how much" money it rolled over (and did not refund to the members) in 2022, 2023, and 2024.

During the COVID-19 Pandemic, the PMA Board (composed of Pat Eklund and Michael Christian) recorded six Liens - that were for delinquent assessments of less than $400! For example, one of the debts was only $207! When Liens are recorded, an extra "Trustee Fee" of about $1,100 is added. These outrageous punishments were not warranted.
The hierarchy is: 1) The Articles of Incorporation, 2) the Declaration of Covenants, Conditions, and Restrictions (CC&Rs), the Bylaws, and the Operating Rules. For example, the Election Rules are Operating Rules.

DownloadIn the 2024 Budget Report, the PMA Board included a "slush fund" of $18,358 for "Insurance Deductible." As a result, the Board increased each 2025 Regular Assessment (paid by the 342 sets of members) by $50 more than it should have. In addition, the Board can borrow funds from the "Reserve Account" for litigation, if needed.
Because the Association is a "Non-profit Mutual Benefit Corporation," these forms are published at the California Secretary of State's public website at www.sos.ca.gov. The form that Bayside Management filed is inaccurate because the address for the two Officers is not in Petaluma (at the Steward Property Services address).

DownloadOn April 13, 2023, the PMA Board proposed a set of "Enforcement and Fine Policy and Procedures" to the Members. The current fine amounts, of "$10.00 to $50.00 per occurrence or continuation of violations," were published in the 2022 PMA Policy Report. See below. In contrast, the Board's proposed fine increases include fine amounts of $100 to $4,000 "per occurrence" and $1,500 for "continuing violations." Due to the unreasonably high and unexplained increases in the "revised" proposal, all of the Board's proposals are invalid and unenforceable.
In addition, if the PMA Board votes to approve the outrageous fine increases, the Members have the right to gather signatures from 18 PMA Members (representing 5% of the 342 Members) to "reverse the rule changes." In addition, the members have the right to petition to "recall" the entire Board.

The CFD "facilities" include the linear parkways and soundwalls along Ignacio Blvd - all of which is on property that is controlled by the City of Novato. The Novato Public Works Department provides the services to maintain the parkways and the soundwalls. From the City of Novato: "The (CFD) issued bonds in 2002 and most recently re-financed the bonds in 2020. The final maturity of the debt is 2032, but the services/maintenance component of the tax continues in perpetuity." In March 2020, PMA Board member Pat Eklund requested an opinion letter from the Fair Political Practices Commission (FPPC) about the maintenance of the Pointe Marin CFD. The FPPC concluded: "No facts indicate that a change in status quo is at all necessary, let alone to the City's benefit." This means that the City of Novato will not transfer its maintenance responsibilities for the Pointe Marin CFD to any other entity - including the Pointe Marin Association.
